Notices of Substitute Trustee Sales (Foreclosure Notices)
Texas is a non-judicial foreclosure state. Default is defined in the Deed of Trust (Mortgage) and/or Promissory Note. When a debt is defaulted a Substitute Trustee's sale will take place in the manner authorized by the Deed of Trust/Promissory Note.
These documents are neither County Clerk records, nor permanent records. Each month's file is destroyed the day after the sale. For these reasons, the postings are neither indexed nor searchable at this time. The Clerk's office apologizes for any inconvenience you may experience. The City of Fort Worth has 2 types of properties for sale, City Surplus Property (also known as City fee-owned because it is owned in fee-simple) and Tax-Foreclosed Property. The sale of City Surplus property is regulated by Texas Local Government Code Chapter 272; Chapter 21, Subchapter E of the Texas Property Code; Texas Local Government Code §253.014(e); and/or Chapter XXI, Section 5 of the Fort Worth City Charter. The sale of tax-foreclosed property is regulated by Chapter 34 of the Property Tax Code.
Potential buyers are urged to perform their due diligence on any Tax-Foreclosed or City Surplus Property they are interested in buying. All properties are sold "as is" and may be subject to redemption if the tax foreclosure redemption period has not expired.
